THCa flower in Virginia
Virginia's hemp landscape is more restricted than its neighbors. The state passed SB 903 in 2023, which capped THC content in hemp products at 0.3% AND limited total THC (including THCa) to 2mg per package. Most THCa flower in the broader market exceeds this cap. Below: what we ship into Virginia, what we don't, and the practical buying guide.
Virginia's 2023 hemp restrictions
Unlike NC, SC, GA, FL, and TX (which all follow federal hemp law unchanged), Virginia enacted state-level restrictions in 2023:
- Per-product THC cap: hemp products in Virginia are capped at 2mg total THC (Delta-9 + THCa + Delta-8 etc.) per package — much stricter than the federal 0.3% Delta-9 threshold.
- Effect on THCa flower: most commercial THCa flower (15-30% THCa per gram) exceeds the 2mg cap by orders of magnitude. So while the federal law allows it, Virginia's stricter rule restricts what can be sold or shipped to Virginia consumers.
- CBD products + low-THC products still legal under the cap.
Bottom line: We do not currently ship THCa flower to Virginia addresses. Our checkout enforces this — Virginia ZIPs are blocked from completing an order on any product that exceeds VA's THC cap.
What you can buy from Virginia
Virginia customers can still order from us:
- Pure CBD tinctures + topicals — non-psychoactive, well under the 2mg threshold per package
- Hemp seed products — also unaffected
- Low-dose CBD edibles — typically meet the cap
If you're in Virginia and want THCa flower specifically, your options are:
- Drive to North Carolina — pickup at our Charlotte location, take it home (interstate transport of federally-legal hemp is your legal call to make)
- Ship to a non-VA address — some VA customers ship to family or work addresses outside the state
- Wait for the law to change — there's pending advocacy to reverse SB 903; we'll update if it does
Why we comply rather than push the rule
It would be possible to interpret federal law as preempting Virginia's state restriction. Some retailers do ship to VA on this argument. We don't, for two reasons:
- Customer protection — if Virginia receivers a shipment that violates state law, the customer (not the retailer) often catches the legal exposure.
- Compliance posture — we want our retail license to be unambiguously clean. Picking fights with state law is short-term thinking.

Can I buy THCa flower in Virginia at all?
Through us, no. Virginia's 2023 SB 903 caps total THC per package at 2mg, well below what commercial THCa flower contains. Some other retailers may ship; check their terms and your local risk tolerance.
Why is Virginia stricter than NC, GA, SC?
Virginia's General Assembly passed SB 903 in 2023 specifically to restrict the hemp-derived intoxicating products market that emerged after the 2018 Farm Bill. NC, SC, GA, and most southeastern states have not followed.
Can I drive to NC and bring it back to Virginia?
Federally compliant hemp products can be transported across state lines. Whether the product is legal once you're back in Virginia depends on whether it complies with VA's local rules. Most THCa flower wouldn't. We're not in a position to give legal advice on this.
